General Terms
1. Applicability
These general business terms are applicable to contracts on participation in courses as well as all other services provided to the participants by Nautitec. Participants in these business terms are consumers as well as business owners/merchants in accordance with civil code.
2. Data storage
The participant declares to agree with the electronic storage of his/her data in accordance with the Federal Data Protection Act (BDSG) for the purpose of processing and settlement of the contract.
3. Content of the course
All course content as well as course locations and times can be derived from the respective course descriptions.
4. Enrolment
Only written enrolments can be ensured and will be processed in order of arrival. With the enrolment the participant declares to agree to the general terms of business. The contract is concluded through written confirmation of registration of the participant by Nautitec. With the conformation the participant receives any necessary further information. With the application, or in any case prior to the course, the participant has to present all necessary documents for the respective course as per course-description. An incomplete application shall entitle Nautitec to withdraw from the contract and to demand a processing fee amounting to 50% of the course fee from the applicant. The applicant is called for conscientious co-operation and should thus contribute to the overall success of the course.
5. Payment
The course fee is due within 14 day after receipt of the invoice. Acquired certificates, course materials as well as a catering package are included in the course fee. Nautitec is entitled to charge interest on arrears in accordance with the statutory provisions for late payment.
6. Cancellation
The cancellation of the participant from the contract is possible at any time before start of the course. Thereby, the following provisions shall apply
- The resignation should be clarified in writing.
- Resignation is free of costs up to 14 day before the start of the course.
- 14 to 7 days before start of the course a compensation package of 50% of the course fee is applicable.
- Within 7 days of the start of the course a compensation package of 100% of the course fee is applicable.
After consultation with Nautitec however, the designation of a substitute participant is possible, to take over the contract of the participant. In this case the compensation package expires.
If there is an important reason, Nautitec is entitled to cancel a course, for example, if the required number of participants has not been reached or the instructor is ill
In this case, there is no payment obligation of the participant and payments already made will be refunded in full or a alternative course will be offered. Any further claims of the participant to Nautitec are not valid.
7. Participation certificates
Nautitec, as Simulation- and training centre, is certified by Lloyd's Register Quality Assurance Limited with ISO 9001:2015. Most of the courses are certified according to the BSH or to the standard of IMO-Model-Courses.
8. Liability
Nautitec shall be liable for all legal and contractual claims in case of intentional or grossly negligent behaviour. For damages, caused by the breach of essential contractual obligations, the liability is limited to the contract-typical, foreseeable damage. A liability for consequential damages or other claims for damages are excluded.
9. Effectiveness
Should individual provisions be or become invalid, this shall not affect the validity of the remaining provisions. In addition, the statutory provisions shall apply.
10. Jurisdiction
Exclusive jurisdiction for commercial transactions is Leer. Only German law applies.
